These Terms of Service (“Terms”) govern your use of ensv2marketplace.com and any subdomain lease arrangements entered into with ENSv2 Marketplace™, operated by Craig Vsetula LLC, a Michigan limited liability company (“we,” “us,” or “the Company”).
By contacting us, using this website, or entering into a subdomain lease arrangement, you agree to these Terms.
1. Nature of the Service — Right to Use License
ENSv2 Marketplace™ offers subdomain lease arrangements under premium .eth parent domains. All arrangements are structured as a limited, non-exclusive right to use license for a defined period. No property, ownership interest, or title to any ENS name is transferred at any time.
Parent domains remain the sole property of Craig Vsetula LLC and are never sold, transferred, or encumbered. The lease grants you the right to use a subdomain under a specified parent name for the agreed lease term only.
2. Lease Terms
- Duration: Annual leases, renewable at the lessee’s option subject to continued availability
- Payment: Annual lease fee in ETH or USDC, due at commencement and each renewal date
- Renewal: We commit to maintaining and renewing all parent domains for the duration of any active lease. Upon request, we will renew the parent domain for up to 20 years
- Expiry: If a lease is not renewed, the subdomain expires automatically. No grace period is guaranteed
- Rates: Lease rates are fixed at initiation and will not increase during an active term. Rates for renewal terms may be adjusted with 60 days notice
- No Subletting: Subdomain leases may not be transferred or sublet to a third party without written consent, unless the name carries a Transferable Rights designation
3. Acceptable Use
You agree not to use your leased subdomain for any purpose that:
- Violates any applicable law or regulation
- Infringes the intellectual property rights of any third party
- Facilitates fraud, money laundering, or sanctions evasion
- Misrepresents affiliation with a government entity, financial regulator, or official body in a deceptive manner
We reserve the right to terminate a lease immediately and without refund if any of the above conditions are discovered.
4. ENSv2 Launch Timing
Automated subdomain leasing infrastructure is dependent on the launch of ENSv2 by ENS Labs on Ethereum L1. Craig Vsetula LLC makes no warranty or guarantee regarding the timing of ENSv2’s launch. Current lease arrangements are executed manually and remain valid regardless of ENSv2 launch timing.
5. Limitation of Liability
To the maximum extent permitted by applicable law, the total liability of Craig Vsetula LLC for any claim arising out of or related to a subdomain lease arrangement is limited to the amount paid by the lessee for the current lease term.
Craig Vsetula LLC is not liable for:
- Loss of business, revenue, or profits arising from subdomain unavailability
- Smart contract bugs, blockchain network failures, or third-party protocol changes
- ENS protocol changes, upgrades, or deprecations made by ENS Labs
- Ethereum network congestion, gas price spikes, or L1 downtime
- Any indirect, incidental, consequential, or punitive damages of any kind
6. No Warranty
The website and all services are provided “as is” without warranty of any kind, express or implied. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.
7. Intellectual Property
ENSv2 Marketplace™ is a registered trademark of Craig Vsetula LLC (USPTO Serial No. 99524052). All site content, the ENS Ontology, the scoring taxonomy, and the portfolio structure are proprietary works of Craig Vsetula LLC. Unauthorized reproduction or commercial use is prohibited.
8. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles. Any dispute arising from these Terms or a lease arrangement shall be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in Michigan. Each party bears its own legal costs unless the arbitrator awards otherwise.
9. Modifications
We reserve the right to update these Terms at any time. Material changes will be posted to this page with an updated effective date. Continued use of the site or an active lease arrangement following notice of changes constitutes acceptance.
